Local Law 126 Parking Garage Inspection

What Local Law 126 Requires

Local Law 126 of 2021 requires owners of parking structures in New York City to hire a Qualified Parking Structure Inspector (QPSI) to inspect the structure and file a condition assessment report with the Department of Buildings at least once every six years. A QPSI is a New York State licensed Professional Engineer who has been designated by DOB.

The requirement covers open and enclosed parking garages, including parking space inside or under a building. It does not cover auto body and repair shops, showrooms or service stations, garages with occupancy of fewer than three cars, unenclosed and unattached lots, or garages serving one- and two-family homes.

BC360 confirms whether Local Law 126 applies to your building, coordinates the QPSI, and tracks the report and any repairs through DOB.

Local Law 126 Filing Windows and Ratings

Filing windows are set by community district under 1 RCNY §103-13 and repeat every sixth year. The Cycle 1 windows:

  • Manhattan Community Districts 1 to 7: January 1, 2022 to December 31, 2023
  • Manhattan Community Districts 8 to 12 and all Brooklyn Community Districts: January 1, 2024 to December 31, 2025
  • All Bronx, Queens and Staten Island Community Districts: January 1, 2026 to December 31, 2027

What the report and DOB require:

  • The QPSI files the report in DOB NOW: Safety within 60 days of completing the condition assessment
  • Each structure is classified Safe, Safe with Repairs and/or Engineering Monitoring (SREM), or Unsafe
  • Unsafe conditions must be corrected within 90 days of filing the report, and an amended report filed within two weeks of completing the repairs
  • An SREM filing generally needs a new condition assessment and amended report no later than two years after the initial filing
  • An SREM repair not completed by the next cycle must be reported as unsafe
  • Completed annual observation checklists are kept on site and shown to DOB or the QPSI on request
  • Buildings in the façade (FISP) program can move the garage filing window to match the next FISP window by telling DOB at least 180 days before their assigned window ends
  • Penalties after the window closes: $1,000 per month for a late initial report, $5,000 per year for failing to file, $1,000 per month for failing to correct unsafe conditions, and a one-time $2,000 for failing to correct SREM conditions

How it works

How We Manage Your Local Law 126 Inspection

01

Confirm the filing window

We confirm the garage is a covered parking structure, find its community district and filing window, and check DOB records.

02

Coordinate the QPSI

A DOB-designated Qualified Parking Structure Inspector performs the condition assessment and classifies the structure.

03

Track the report

We track the QPSI's report filing in DOB NOW: Safety within 60 days of the completed assessment.

04

Manage repairs and follow-ups

We coordinate repairs, permits, amended reports and SREM follow-ups with the QPSI and licensed contractors.

What Is Included?

Our Local Law 126 inspection management may include:

  • Confirmation that the garage is a covered parking structure
  • Community district and filing window lookup
  • A check of DOB records for past reports and violations
  • Coordination of a DOB-designated QPSI
  • Scheduling of the condition assessment
  • Tracking of the 60-day report filing
  • Coordination of licensed contractors for repairs and any required permits
  • Tracking of the 90-day unsafe-condition repair deadline and amended reports
  • Tracking of SREM repair timeframes and the two-year follow-up
  • Coordination of extension requests when repairs need more time
  • Organization of the annual observation checklists kept on site
  • Portfolio-wide garage inspection scheduling

Why Is This Service Important?

Local Law 126 penalties start once the filing window closes and keep building by the month or the year, from $1,000 per month for a late initial report to $5,000 per year for failing to file.

The classification also sets the clock. An Unsafe rating means immediate public protection and repairs within 90 days, and SREM conditions left unrepaired have to be reported as unsafe in the next cycle. For garages in the Bronx, Queens and Staten Island, the current filing window closes December 31, 2027.

Our Service Is Designed For:

  • Owners of buildings with enclosed or open parking garages
  • Residential buildings with parking under the building
  • Condominium and cooperative boards
  • Property managers and managing agents
  • Mixed-use and commercial building owners
  • Parking garage operators working with owners
  • Real estate portfolios
  • Buyers reviewing a building with a garage

Why Choose BC360?

BC360 tracks Local Law 126 next to the building's façade (FISP) cycle and other periodic inspections, so the garage report, repairs and façade work can be planned together where they overlap.

BC360 does not perform engineering work. Condition assessments, classifications and reports come from a licensed Professional Engineer designated as a QPSI. BC360 coordinates the inspector, contractors and filings and keeps every deadline in view.
